Privacy Policy

BasementResponsePro ("we," "us," "our") operates a contractor-matching service that connects homeowners with independent, licensed foundation repair and basement waterproofing contractors. This Privacy Policy describes what we collect, how we use it, and your choices.

Information we collect

When you submit a request through our website, we collect the information you provide, which typically includes: your name, phone number, email address, ZIP code, city, state, a description of the issue, urgency level, and whether you have homeowner's insurance. We also automatically collect limited technical data such as IP address, browser type, and pages viewed for analytics and fraud prevention.

How we use your information

We use the information you provide to match you with one or more independent contractors in our network who serve your area. We may share your submitted information with those contractors so they can contact you regarding your repair needs. We may also use your information to improve our service, prevent fraud, comply with legal obligations, and — with your consent — send you occasional communications about related resources.

Communication consent

By submitting a request, you consent to being contacted by phone, SMS, or email by one or more licensed contractors in our network regarding your repair needs. This consent is not a condition of any purchase. Standard message and data rates may apply. Automated technology may be used. You can revoke this consent at any time by asking the contractor directly or by contacting us.

Information sharing

We share the information you submit with independent contractors in our network who may serve your area. These contractors are independent businesses and have their own privacy practices; once information is shared, it is subject to their policies as well as ours. We do not sell your personal information to third parties unrelated to contractor matching. We may share aggregated, anonymized data for analytical purposes.

Your choices & rights

You may request a copy of the personal information we hold about you, ask us to correct inaccurate information, or request deletion of your information, subject to legal exceptions. Residents of certain U.S. states (including California, Colorado, Connecticut, Virginia, Utah, and others) have additional rights under state privacy law. California residents — CCPA / CPRA notice

If you are a California resident, the California Consumer Privacy Act of 2018 (CCPA), as amended by the California Privacy Rights Act (CPRA) (Cal. Civ. Code § 1798.100 et seq.), gives you specific rights regarding your personal information.

Categories of personal information we collect: identifiers (name, email, phone, IP address); commercial information (the service you requested); geolocation data (ZIP, city, state); internet/network activity (pages viewed, user agent); and inferences drawn from that information (matching to an appropriate contractor).

Sources: directly from you when you submit a request; automatically from your device (IP, user agent, referrer); and from our network partners when they confirm service delivery.

Sale or sharing of personal information. Under the CPRA's broad definition, our practice of forwarding submitted contact information to one or more contractors in our network constitutes a "sale" or "sharing" of personal information. We do not knowingly sell or share the personal information of consumers under the age of 16.

Your CCPA/CPRA rights. You have the right to:

  • Know what personal information we have collected about you and how it has been used or disclosed
  • Delete your personal information, subject to specified exceptions (response within 45 days)
  • Correct inaccurate personal information we maintain about you
  • Opt out of the sale or sharing of your personal information — see our Do Not Sell or Share My Personal Information section below
  • Limit the use of sensitive personal information (we do not currently use sensitive PI for any purpose other than fulfilling your service request)
  • Non-discrimination — we will not deny services, charge different prices, or provide a different level of service if you exercise any CCPA right

To exercise any of these rights, email privacy@basementresponsepro.comwith the subject line "CCPA Request" and a description of the request, or use the opt-out form below for a Do-Not-Sell request.

We will verify your identity before fulfilling any access/deletion request. Authorized agents may submit requests on your behalf with written authorization.

Do Not Sell or Share My Personal Information

California residents may opt out of the sale or sharing of their personal information at any time, free of charge. Submitting an opt-out request through our self-service form below stops BasementResponsePro from forwarding your contact information to any contractor in our network. Note: opt-out does not retroactively recall information already shared; you may need to contact a specific contractor directly to request deletion from their records.

We honor Global Privacy Control (GPC) browser signals as a valid opt-out request from California residents.

State-specific telephone-solicitation rights

Connecticut residents — 21-day right to revoke. Under Connecticut Public Act 23-56, Connecticut residents have the right to revoke any consent provided to BasementResponsePro within twenty-one (21) days of submission, without cause and without affecting any service already requested.

Florida, Washington, Oklahoma, Maryland residents. These states impose stricter consent requirements than federal TCPA under their respective mini-TCPA statutes (Fla. Stat. § 501.059, RCW 80.36.400, Okla. Stat. tit. 15 § 775C.1+, Md. Comm. Law Code § 14-3201). Residents of these states may revoke consent at any time using the opt-out form below.

Massachusetts residents. Massachusetts residents are protected by MGL Ch. 159C lead-seller provisions and MGL Ch. 93A consumer-protection statute. Revocation rights are honored without delay.

New York residents. Under New York General Business Law § 399-p and related Department of Public Service rules, New York residents have full revocation rights enforceable by the New York Attorney General.

New Jersey residents. Under NJSA 56:8-119 and the Truth in Consumer Contract, Warranty, and Notice Act (TCCWNA), New Jersey residents retain all statutory rights without limitation.

Texas residents. Under the Texas Business & Commerce Code § 302 and the Texas Data Privacy and Security Act (TDPSA), Texas residents have rights to access, correct, delete, and opt out of the sale of their personal information. Email privacy@basementresponsepro.com to exercise.

Pennsylvania residents. Under the Pennsylvania Telemarketer Registration Act (73 P.S. § 2241 et seq.), Pennsylvania residents have full opt-out rights and protections against unsolicited telephone solicitation.

Illinois residents. Under the Illinois Restricted Call Registry Act (815 ILCS 305) and the Telephone Solicitations Act, Illinois residents have full revocation rights.

Colorado residents. Under the Colorado Privacy Act (C.R.S. § 6-1-1301 et seq.) and Colorado No-Call List (C.R.S. § 6-1-308), Colorado residents have rights to access, correct, delete, opt out of targeted advertising, sale of personal data, and profiling.

Virginia residents. Under the Virginia Consumer Data Protection Act (VCDPA, Va. Code § 59.1-575 et seq.) and the Virginia Telephone Privacy Protection Act (Va. Code § 59.1-510), Virginia residents have analogous rights to those of California residents (access, correct, delete, opt out of sale/targeted advertising/profiling).

Ohio residents. Under the Ohio Consumer Sales Practices Act (ORC § 1345) and ORC § 109.87, Ohio residents have full revocation rights and protections enforceable by the Ohio Attorney General.

Michigan residents. Under the Michigan Home Solicitations Sales Act (MCL § 484.125) and the Michigan Telemarketing Sales Rule (MTSR), Michigan residents have full opt-out rights including a separate right to cancel home solicitation contracts within 3 business days.

Retention period

Submitted contact data is retained for five (5) years from the date of consent for federal TCPA audit-defense purposes. For residents of states with extended retention requirements (currently FL, WA, OK, MD, MA, CT, NY, NJ, CA, TX, PA, IL, CO, VA, OH, MI), the retention period is seven (7) years. Deletion requests under CCPA/CPRA, VCDPA, CPA, or TDPSA are processed within 45 days regardless of retention period, subject to statutory exceptions for audit and legal compliance. Opt-outs are permanent and honored across our entire portfolio of related sites.

Do Not Call / Opt-out

You may opt out of marketing communications from us at any time by replying STOP to an SMS, clicking unsubscribe in an email, by contacting us, or by using the form below.

Submit either your phone number, your email address, or both. Both will be added to our portfolio-wide Do Not Contact list and any previously stored lead matching either field will be flagged as revoked.

We honor opt-out requests within 24 hours across every site we operate. For SMS, you may also reply STOP at any time. For questions, email optout@basementresponsepro.com.

Contractors in our network are responsible for their own opt-out handling — if you no longer wish to hear from a specific contractor, you may inform them directly. Submitting the form above also flags any historical lead we hold matching your phone or email as revoked, so it will not be re-shared with any new contractor.

Data security

We use commercially reasonable administrative, technical, and physical safeguards to protect the information you submit. No method of transmission over the internet is 100% secure, so we cannot guarantee absolute security.

Children

Our service is directed to adults (18 or older) who own or rent residential property. We do not knowingly collect information from children under 16.

Changes

We may update this policy from time to time. We'll update the "Last updated" date at the top when we do. Material changes will be highlighted on our homepage or by other notice.
